MINUTES, JULY 20, 1999





The School Board of Escambia County, Florida, convened in Special Meeting at 5:30 p.m. (followed by the Public Forum and Regular Meeting as advertised) in Room 160, Hall Center, 30 East Texar Drive, Pensacola, Florida, with the following present:

Dr. Mason called the Special Meeting to order at 5:30 p.m.

Discussion of 1999-2000 Budget

Mrs. Patricia Wascom, Assistant Superintendent for Finance and Business Affairs, advised that this meeting was called in compliance with Florida Statute and TRIM (Truth in Millage) guidelines and to approve for advertising only the Tentative Millage Rate and Tentative Budget for 1999-2000. Ms. Barbara Linker, Director of Budgeting, reviewed the District Summary Budget as filed for the record (Supplementary Minute Book, Exhibit A) reflecting total budget of $417,284,254.30, less transfers in the amount of $5,966,947.30, for a net budget of $411,327,307.30. She reviewed changes since last week noting the Florida Department of Education (FDOE) had certified the Required Local Effort Millage rate of 6.251. The Florida Department of Revenue (FDOR) accepted the Property Appraiser's tax roll which was almost $288,000,000 more than the original estimated roll. Overall statewide the tax rolls were $6,000,000,000 more than that estimate; therefore, taxpayers benefitted from the higher tax roll and our millage rate went down. Ms. Linker explained the rollback rate and noted total millage rates at 4.14 percent less than the rollback rate. She stated that the advertisement will be a notice of budget hearing, because taxes are not increasing and we are not going over the rollback rate, so we do not have to advertise a notice of tax increase. The total proposed millage rate compared to last year is 5.45 mills overall less than the millage rate for 1998-99. Ms. Linker stated that the tax roll had gone up 4.37 percent this year; however, this was not the final tax roll and the tax roll will change.

After discussion, motion by Dr. DeWitt, second by Mrs. Stidham, to approve advertisement of the budget hearing, budget summary, and graph (Tentative Millage and Tentative Budget for 1999-2000), was unanimously approved.



PUBLIC FORUM

Dr. Mason called the public forum to order at 6:00 p.m.

1) Mr. Mike Jackson, 1316 East Lloyd Street, Pensacola, Florida, 32503, stated that he owns a home located by the new N. B. Cook Elementary School, and he asked if something could be done to reduce the excessive noise generated by the equipment, chiller tower and chiller room at the construction site. After discussion, Dr. Mason referred Mr. Jackson to Dr. David Epperson, Assistant Superintendent for Facilities Planning and Maintenance.

2) Mr. Kit McCulley, 9810 Hollowbrook Drive, Pensacola, Florida, 32514, stated that last year his daughter attended McArthur Elementary School, and their request for out-of-district transfer (from Ferry Pass Middle School to Ransom Middle School) was denied by the Transfer Committee. He asked that the Board reconsider their request based on academic reasons noting that Ransom offers a program of advanced math classes in sixth and seventh grades. Mr. Gene Pettis, Assistant Superintendent for Curriculum and Instruction, advised that the schools offer the same mathematics courses, and the difference is only the style or strategy in which the individual school opts to provide that opportunity. At Ransom a specific class is designated for this and in other schools, such as Ferry Pass, it is offered on an accelerated individual basis. Mr. Pettis noted that Mr. Ireland Brock, Director, Pupil Instructional Support Services, had checked records as to whether programmatic transfers had been granted based on designation of an individual class and that was not the case. Mr. Pettis stated that he had conferred with Dr. Robin Largue, Director of Secondary Education, to make sure the data used was valid in terms of student success. He stated that staff would continue to look to determine if there are enough children that fall into this category that the school would wish to do something differently. Dr. Mason stated that it was the consensus of the Board that there is a level playing field with the assurances provided by Mr. Pettis addressing the curriculum issues.

3) Ms. Cathy Roche, President, Escambia County Council of PTAs, reported that the State Florida PTA leadership conference was held recently in Tarpon Springs, Florida, and that Ensley Elementary School won the award from Regions Bank for "Best Parent Involvement Program" for the region as well as for the State of Florida. Ms. John Dell Hucabee, Principal, Ensley Elementary School, spoke concerning activities which had been implemented to promote parental involvement.

4) Mr. Harry Evans, 13711 Canal Drive, Pensacola, Florida, 32507, spoke concerning the 1999-2000 budget and management audit.



Dr. Mason called the Regular Meeting to order at 6:30 p.m. The invocation was given by Dr. John DeWitt, School Board Member, and the Pledge of Allegiance was led by Dr. Wes Davis, Director, Evaluation Services.

Recommend that, consistent with the decision of the due process committee, student number 99-259-601 be expelled from all public schools of Escambia County for the remainder of the 1998-99 school year and all of the 1999-2000 school year. It is further recommended that the student be given the option to enroll, if qualified and if space is available, in an alternative educational program exclusive of regular school placement. Placement to be at the discretion of the Superintendent and to be available as an alternative during the full expulsion time frame.

Mr. May announced that the Regular Board Meetings were now being televised. He introduced Ms. Melanie Gambil, Instructional Video Specialist; Miss Sharmir Gadsen, Tate High School student; and Ms. Wanda Reed, PATS teacher, who operated the television cameras.



PTA PRESENTATION

Ms. Cathy Roche, President, Escambia County Council of PTAs, reported that PTA representatives have been asked to participate on ten district committees and give input on children's issues. PTA goals this year include continued parental involvement, and planning is underway for a county-wide parent education workshop. On July 8-11, 1999, over 1,000 PTA volunteers from around the state met in Tarpon Springs to share information to prepare leaders for their roles of impacting the educational system and raising children. Ms. Roche noted that the PTA State Board of Directors had voted to join the lawsuit opposing vouchers based on the belief that public schools should be fully funded and continuously improved and concern that vouchers will harm rather than help the children of the State of Florida.

2. Report from One-Half Cent Sales Tax Watchdog Committee.

Dr. Alton Butler, Chairman, One-Half Cent Sales Tax Watchdog Committee, presented the quarterly report reflecting total tax revenue figures in the amount of $19,495,857.89 as of June 30, 1999. The addition of the quarterly discretionary dollars in the amount of $1,282,739.65 and interest earned in the amount of $628,751.14, brings the total dollar figure to $21,407,348.68. Total expenditures have been $2,058,516.89 with total monies encumbered in the amount of $13,877,693.59. Dr. Butler stated that since the tax went into effect in January, 1998, every dollar has been spent for the specific projects the voters approved in the referendum in November, 1997. He reported concerning projects including the new building which is almost completed at E-SEAL, replacing numerous portables; Hallmark Elementary School - new Media Center which will replace a seventy-year old library; Holm Elementary - new wing of classrooms; and Yniestra Elementary - parking area and bus loading areas. The new K-5 school on the westside (Dog Track Road) is scheduled to open in fall of 2000 and will be totally funded from the proceeds of the One-half Cent Sales Tax. Committee members have been assigned to subcommittees to visit project sites periodically. The committee meetings are held on the third Thursday of each month and are open to the public.

3. Approval of administrative appointments.

Motion by Dr. DeWitt, second by Dr. Jenkins, to appoint Ms. Michelle Cox as the Assistant Elementary Principal at Cook Elementary School, was unanimously approved.

Motion by Dr. Jenkins, second by Dr. DeWitt, to appoint Ms. Linda Harageones as the Program Evaluator at McMillan Center, was unanimously approved.

Motion by Dr. DeWitt, second by Dr. Jenkins, to appoint Ms. Martha Ward as the Assistant Elementary Principal at Oakcrest Elementary School, was unanimously approved.

The meeting returned to the regular agenda.

Motion was made by Mrs. Gilley to approve the contract for this year, pending a close relationship with the Curriculum Department in making sure the Board's concerns are addressed, in particular the concerns that Dr. Jenkins had expressed at the Board Workshop and also Dr. DeWitt, mostly because of the timely fashion that we have for the consideration of parents who are interested in the AP classes, for example trigonometry. Dr. DeWitt stated that he would not vote for the proposal due to very limited controls and no history of success with our students in that no students have completed. He also expressed that there is an extra burden on staff with extra responsibilities of testing. Dr. Mason asked if staff had provided cost analysis data, a needs assessment, or evaluation of the effectiveness thus far. Mr. Pettis stated that this program had been in place for a couple of years and had not seen a successful track record in the district in terms of completion, whether home school, private, or public school students. After discussion, Dr. Mason called for the vote and the motion was approved 3-2, with Dr. DeWitt and Dr. Jenkins voting NO.

4. Appointment to the School Readiness Coalition.

Motion by Dr. DeWitt, second by Dr. Jenkins, to appoint Mr. Wayne Odom, Director of Title I, to serve on the School Readiness Coalition representing the School Board, was unanimously approved.

5. Revised 1998-99 Instructional Salary Schedule, reflecting 11.5 month contract, approved by the Board at the Continued Session of June 24, 1999.

Mr. May advised that this was to be presented to the Governor at the Cabinet

Meeting in August, and the Escambia Education Association has given acceptance (for the two schools - A. A. Dixon and Spencer Bibbs Elementary Schools). Motion by Dr. DeWitt, second by Dr. Jenkins, to approve the adoption of the 11.5 month contract, was unanimously approved.

6. Administrative/Professional Salary Increases.

Motion was made by Dr. Jenkins to discuss this item. Said motion died for lack of second.

STUDENT RECOMMENDATIONS:

The following item was moved forward:

NOTES: Item Number 16, Student Number 99-255-411, Request to Address the Board

16. Recommend that, consistent with the decision of the formal hearing officer, student number 99-255-411 be expelled from all public schools of Escambia County for all of the 1999-2000 school year. It is further recommended that the student be given the option to enroll, if qualified and if space is available, in an alternative educational program exclusive of regular school placement. Placement to be at the discretion of the Superintendent and to be available as an alternative during the full expulsion time frame.

Motion was made by Dr. DeWitt as follows: "I have read the transcript of the hearing, read the hearing officer's ruling and the brief filed on behalf of the student by the attorney. Based on this review, I will make my motion based on the following findings of fact by the hearing officer in his ruling and some additional testimony in the record:

1) Page 4 of the Order: The hearing officer found that the student did not consider the nail clippers to be a weapon; and

2) Page 4 of the Order: The expulsion recommendation is not based on a zero tolerance policy; Page 25(8) of the transcript: If the student inadvertently brings something, they are forgiven; Page 53(5) of the transcript: Discussion of penalty for first offense allows for some discretion on the part of the school; Page 65(8) of the transcript: Quote indicating that the administration has flexibility in applying the guidelines.

Based on these facts as taken from the records, I would move that: 1) Student Number 99-255-411 be expelled from the Escambia County Schools for the period of May 17, 1999, to the end of the academic school year, May 30, 1999; 2) that Student Number 99-255-411 be allowed to attend Pensacola High School for the academic year 1999-2000 but that she be placed on probationary status, and if there are any disciplinary actions, she be immediately subject to full expulsion for the remainder of the school year, subject to placement in an alternative program. If Student Number 99-255-411 completes the school year 1999-2000, without any disciplinary problems, her academic records will be purged of any mention of this disciplinary action." The motion was seconded by Dr. Jenkins. Dr. Mason stated that no additional evidence may be submitted at this meeting. He noted that the law allows the School Board to vary from the recommendation of the hearing officer based on School Board Members having reviewed the transcript. The Board Attorney advised that the student had appeared before the due process committee of the school and was given a hearing before that committee, then requested a formal hearing and had a hearing before a hearing officer where she was given an opportunity to present evidence and have witnesses and was allowed to cross examine the administration's witnesses and she was represented by an attorney at that point. Since that time the attorney has asked to address the School Board about this matter. In addition to



being allowed to address the School Board verbally tonight, the attorney representing the student also submitted a brief which was considered by all of the Board Members. Mrs. George made a correction to the agenda in that the penalty recommendation of the hearing officer was that the student be expelled for the 1999-2000 school year. It did not include a recommendation about the current school year. Mr. Joe Hammons, Attorney to the Superintendent, advised that the principal recommended the balance of last year and all of the upcoming school year which is 1999-2000. The hearing officer in his recommendation only identified the upcoming school year of 1999-2000. The recommendation of the Superintendent concurred with the hearing officer only for the upcoming school year. Dr. Jenkins read his reasons for supporting the motion:  "When Ms. Frazier first observed the nail clippers, they were on the desk of LH. They had been used by LH and were in the possession of LH. It appears to me that both girls were equally involved in the clippers being observed by Ms. Frazier. Both girls admitted that they did not think that the item was a weapon. I have serious problems believing this but I want to give both young ladies the benefit of the doubt. If both young ladies were equally involved in this unfortunate incident, why the difference in punishment. The difference in punishment is disproportionate to the relative involvement of the two young ladies. The three-day suspension of LH and the suspension or expulsion of Student Number 99-255-411 for the remainder of the 1998-99 school term are more in proportion for the relative involvement of the two young ladies. To me, this is an unfortunate but unique situation. The widespread publicity had no affect on my decision. In 99% of cases like this, I would support the principal and Superintendent; however, in this unique case with mitigating circumstances, I am voting against expulsion for the 1999-2000 school year."



The Board recognized the following speakers:

1) Mr. Bob Husbands, Executive Director, Escambia NEA UniServ, noted the recommendation of the Association that a committee of employees, administrators, and teachers be convened with appropriate parent representation to further look at the issue of what constitutes a weapon and what constitutes appropriate dealing with weapons so that Board policy can be handled consistently and all students can expect equal treatment regardless of where they attend and all employees can expect reasonable protection.

2) Mr. Eric Stephenson, Attorney representing Student Number 99-255-411, expressed his opinion that the school had a zero tolerance policy that it employed against one student and not another, which was very inconsistent. He asked that there be no expulsion.

Mr. Hammons commented that what is perceived to be an inconsistency between treatment of two students, based on review of the record, the student LH simply borrowed the clipper function during the class. The only testimony was that she knew she was using the clippers. The knife blade was actually enclosed in the body of the knife or in the body of the instrument. There is no reason to believe that LH knew that a knife blade was attached. The hearing officer made a distinction because the other student that is recommended for expulsion did know that the blade was attached. She brought it to school. While she did not perceive it as a blade, the distinction is one student brought the instrument to school with the knife blade attached. The other student did not know that blade was there, so they are not two students equally situated.

3) Mr. Norm Ross, Principal, Pensacola High School, discussed the zero tolerance

policy concerning weapons on campus. He expressed that they go the extra mile in terms of allowing students to know what is tolerable and what is not tolerable on campus. He noted that a display was given at the beginning of the year, of which this particular student was aware; in addition, the student took the test that displayed she had perfect knowledge of what is expected at PHS, and she passed the test. He expressed that a two inch (2") blade knife could cause serious injury or death, and he asked the Board to reconsider this matter.





After discussion, Dr. Mason called for the vote and the motion was unanimously

approved.

The meeting returned to the regular agenda order.



Motion by Dr. DeWitt, second by Dr. Jenkins, to approve the Superintendent's recommendations for all of the other students referenced in Item Numbers 7-15, 17-22, and 24-29, with formal hearing granted for Item Number 23, was unanimously approved.

7. Recommend that, consistent with the decision of the formal hearing officer, student number 99-110-151 be expelled from all public schools of Escambia County for the remainder of the 1998-99 school year and all of the 1999-2000 school year. It is further recommended that the student be given the option to enroll, if qualified and if space is available, in an alternative educational program exclusive of regular school placement. Placement to be at the discretion of the Superintendent and to be available as an alternative during the full expulsion time frame.

8. Recommend that the indefinite suspension of student number 99-125-281, pursuant to Section 232.26(2), be terminated in that the student was adjudicated delinquent of

a felony offense. I further recommend that the student be expelled from all public schools of Escambia County for the remainder of the 1998-99 school year and all of the 1999-2000 school year with the option to continue in alternative school placement.

9. Recommend that the indefinite suspension of student number 99-163-591, pursuant to Section 232.26(2) Florida Statutes, be terminated in consideration of the Court having declined to adjudicate the student delinquent of a felony offense. I further recommend that the student be expelled from all public schools of Escambia County for the remainder of the 1998-99 school year and all of the 1999-2000 school year with the option to continue in alternative school placement.

10. Recommend that, consistent with the decision of the formal hearing officer, student number 99-193-601 be expelled from all public schools of Escambia County for the remainder of the 1998-99 school year and all of the 1999-2000 school year. It is further recommended that the student be given the option to enroll, if qualified and if space is available, in an alternative educational program exclusive of regular school placement. Placement to be at the discretion of the Superintendent and to be available as an alternative during the full expulsion time frame.

11. Recommend that, consistent with the decision of the formal hearing officer, student number 99-230-281 be expelled from all public schools of Escambia County for the remainder of the 1998-99 school year and the first semester of the 1999-2000 school year. It is further recommended that the student be given the option to enroll, if qualified and if space is available, in an alternative educational program exclusive of regular school placement. Placement to be at the discretion of the Superintendent and to be available as an alternative during the full expulsion time frame.

12. Recommend that, consistent with the decision of the due process committee, student number 99-248-411 be expelled from all public schools of Escambia County for the remainder of the 1998-99 school year and all of the 1999-2000 school year. It is further recommended that the student be given the option to enroll, if qualified and if space is available, in an alternative educational program exclusive of regular school placement. Placement to be at the discretion of the Superintendent and to be available as an alternative during the full expulsion time frame.

13. Recommend that, consistent with the decision of the due process committee, student number 99-251-866 be expelled from all public schools of Escambia County for the remainder of the 1998-99 school year and all of the 1999-2000 school year.



14. Recommend that, consistent with the decision of the due process committee, pursuant to the authority of Section 232.26(2), Florida Statutes, student number 99-252-411 be suspended from all classes of instruction on public school grounds during regular classroom hours until such time as the pending criminal charges are concluded, at which time the Superintendent will make further recommendation regarding suspension, expulsion, or re-enrollment of this student. The indefinite suspension provided herein shall not affect the delivery of educational services to the pupil, and the pupil should be immediately enrolled in a day-time alternative educational program

15. Recommend that, consistent with the decision of the due process committee, student number 99-254-561 be expelled from all public schools of Escambia County for the remainder of the 1998-99 school year and all of the 1999-2000 school year. It is further recommended that the student be given the option to enroll, if qualified and if space is available, in an alternative educational program exclusive of regular school placement. Placement to be at the discretion of the Superintendent and to be available as an alternative during the full expulsion time frame.
