MINUTES, MAY 26, 1998

 

The School Board of Escambia County, Florida, convened in Regular Meeting at 7:01 p.m. in the Board Room at the Administrative Building, 215 West Garden Street, with the following present:

The invocation was given in song by Ms. Candice Pearson, Ms. Haley Pearson, and Mr. Ricky Pearson. The Pledge of Allegiance was led by members of Boy Scout Troop #643.

Chairman Jenkins recognized Mr. Mark Smith, Leader, Troop #643, 112 Southeast Kalash Road, Pensacola, Florida, who requested permission for the troop to have access to their sponsor school (Sherwood Elementary) over the summer. Mr. Smith was advised that Escambia High School could best accommodate their scheduling requirements over the summer.

 

STELLAR EMPLOYEE

Superintendent May asked Mr. Ron Peacock, Construction Project Manager, Facilities Planning, to come forward to be recognized as the Stellar Employee for the month of May. He said that Mr. Peacock has been an employee of the District for ten years, and that he always goes the extra mile, demonstrating pride in every area of his job. Mr. May congratulated Mr. Peacock for this honor, and presented him with a plaque, a pin, and a check for $100 donated by Members First Credit Union.

 

RECOGNITION - INDUCTION INTO THE UNIVERSITY OF FLORIDA

WOMEN'S BASKETBALL HALL OF FAME

Mr. May asked Ms. Quintella Bonner, physical education teacher, A.A. Dixon Elementary School, to come forward to be recognized for her recent induction into The University of Florida Women's Basketball Hall of Fame. Mr. May congratulated Ms. Bonner and presented her with a certificate in recognition of this honor.

PRESENTATION - LEADERSHIP SCHOLARSHIP FROM HERFF JONES

Mr. May asked Ms. Melissa Gormley, Escambia High School senior, and representatives from Herff Jones to come forward. Mr. Aden Sowell, and Mr. Clay Wren, Herff Jones, gave the presentation recognizing Ms. Gormley as the recipient of the Principal's Leadership Award, which entitles her to a $1000 scholarship at the college of her choice.

I. ADOPTION OF AGENDA*

Motion by Dr. DeWitt, second by Mr. Bailey, to adopt the agenda as amended, was unanimously approved.

 

The following item was moved forward:

XI. ITEMS FROM THE SUPERINTENDENT (Item Number 2)

Motion made by Dr. DeWitt and seconded by Mr. Bailey, to approve the Memorandum of Understanding between the School Board of Escambia County and the Escambia Education Association; and the Memorandum of Understanding between the School Board of Escambia County and Escambia Association of Supervisory Employees (EASE), Escambia Education Support Personnel Association (EESPA), and Escambia Education Clerical/Classroom Association (EEC/CA). Dr. Douglas Garber, Director of Employee Services, gave a brief report relative to the collaborative bargaining process.

The meeting returned to the regular agenda order.

 

II. APPROVAL OF MINUTES

Motion made by Dr. DeWitt and seconded by Mrs. Morris, to approve the minutes for the 4/27/98 Regular Board Workshop, 4/27/98 Special Board Workshop, 4/28/98 Regular Board Meeting, and 5/5/98 Special Board Meeting. Dr. DeWitt submitted the following amendments in writing as corrections to the minutes for the 4/28/98 Regular Board Meeting:

On page 12 under item 8.(1) - The statement regarding my support of item 2(a) the Specialist-Network Communications position is correct. The statement regarding items 2(b) and 2(c) is correct, which indicates my approval. The last sentence in that paragraph is correct although inserting the word "other" before the word "three" would make the sentence clearer. Under item (2)(b) and (c) my vote is recorded incorrectly, as I had already voiced my support as outlined in the minutes previously. On page 25, under item IV-X. Consent Agenda - I did not register a NO vote on item V.8.2(b) or V.8.2(c). I move that the above corrections be made to the April 28,1998 minutes.

After discussion, Chairman Jenkins called for the vote on the amendments and the motion was unanimously approved. Mrs. Webb noted that she was going to refer an issue concerning minutes to the Chairman for clarification. Chairman Jenkins called for the vote and the motion to approve the minutes as amended was unanimously approved.

 

III. PROPOSED ADDITIONS OR REVISIONS TO SCHOOL DISTRICT RULES

A. Permission to Advertise

1. 6Gx17-2.15 ANNUAL LEAVE

Motion made by Mr. Bailey and seconded by Dr. DeWitt, to advertise School District Rule 6Gx17-2.15 Annual Leave. Mrs. Webb expressed that equity was a concern regarding the language "Instructional personnel whose normal assignments are extended to either eleven or twelve months may be eligible, if recommended by the Superintendent, to accrue annual leave on the same basis...as administrative and professional personnel..." She asked that the Board consider striking the words "if recommended by the Superintendent." Ms. Gloria Johnson, Director of Payroll, noted that this rule relates to the DROP (Deferred Retirement Option Program) which is required by law to be in place by June 30. Mr. Ray recommended that the Board approve the advertising of the rule change as set forth and any language changes that would need to be researched could be brought back at a subsequent meeting. Relative to the fiscal impact, Mrs. Patricia Wascom, Comptroller, advised that the number of people to enter the program cannot be determined before July 1, and she assured the Board that when the budget is presented, a proposal will be included to provide proper funding for the program.

Chairman Jenkins called for the vote and the motion was unanimously approved.

2. 6Gx17-2.17 SICK LEAVE

Motion made by Mr. Bailey and seconded by Dr. DeWitt, to advertise School District Rule 6Gx17-2.17 Sick Leave. After discussion, Chairman Jenkins called for the vote and the motion was unanimously approved.

3. 6Gx17-2.30 RETIREMENT INCENTIVE

Motion by Mrs. Morris, second by Dr. DeWitt, to advertise School District Rule 6Gx17-2.30 Retirement Incentive, was unanimously approved.

 

4. 6Gx17-2.36 DROP - DEFERRED RETIREMENT OPTION PROGRAM

Motion by Mrs. Morris, second by Mr. Bailey, to advertise School District Rule 6Gx17-2.36 Drop - Deferred Retirement Option Program, was unanimously approved.

 

5. 6Gx17-7.09 PUPIL PROGRESSION PLAN

Motion made by Mrs. Morris and seconded by Dr. DeWitt, to advertise School District Rule 6Gx17-7.09 Pupil Progression Plan. Mrs. Webb discussed concerns regarding a decline in test scores, as well as wording regarding special promotions. Mr. May stated that the 1-2% drop in test scores did not represent a standard deviation, and the ranking had remained essentially average to slightly above average for ten years. Mr. Gene Pettis, Assistant Superintendent for Curriculum and Instruction, noted that very proactive programs have been implemented with a focus on improving test scores, which is producing an upward trend. Chairman Jenkins recognized Mr. Bob Husbands, Executive Director, Escambia Education Association, who commented on variation factors involved in standardized testing and stated that reasonable ways are needed to document individual student progress.

After discussion, the Chairman called for the vote, and the motion was approved 4-1, with Mrs. Webb voting NO.

 

B. Permission to Adopt

1. 6Gx17-1.20 STANDARDS FOR SCHOOL BOARD MEMBERS' CONDUCT

Motion made by Mr. Bailey and seconded by Dr. DeWitt, to adopt School District Rule 6Gx17-1.20 Standards for School Board Members' Conduct. Mrs. Webb stated that she had expressed concerns at the last Board meeting regarding this issue. Dr. DeWitt stated the intent was to set a standard of conduct in order to focus on the business of education, and he called the question (no vote was taken on calling the question).

The Board recognized the following speakers:

1) Mr. Frank McCarthy, 2371 Berrydale Road, Pensacola, Florida, 32534, spoke in favor of adopting standards of conduct for School Board Members.

2) Ms. Janice Blum, 9455 South Loop Road, Pensacola, Florida, 32507, requested that the Board consider adding language to standards of conduct for Board Members to address potential conflicts of interest relative to purchasing and campaign contributions. She also requested a copy of communication from the Ethics Commission relative to business transactions.

Chairman Jenkins called for vote and motion was unanimously approved.

2. 6Gx17-2.13 ADMINISTRATIVE SECRETARY TO THE SCHOOL BOARD

Motion made by Mrs. Morris and seconded by Mr. Bailey, to adopt School District Rule 6Gx17-2.13 Administrative Secretary to the School Board. Mrs. Webb stated that the language was not brought to the Board before advertising. Mrs. Morris read an excerpt from Board minutes of April 28, 1998, and Mr. Ray stated that said minutes approved advertising to allow for multiple year contracts. The Chairman called for the vote and the motion was approved 4-1, with Mrs. Webb voting NO.

3. 6Gx17-5.01 FINANCE AND ACCOUNTING

Motion by Mrs. Morris, second by Dr. DeWitt, to adopt School District Rule 6Gx17-5.01 Finance And Accounting, was unanimously approved.

 

4. 6Gx17-7.02 CODE OF STUDENT CONDUCT: ELEMENTARY RIGHTS AND RESPONSIBILITIES

Motion by Mrs. Morris, second by Mr. Bailey, to adopt School District Rule 6Gx17-7.02 Code of Student Conduct: Elementary Rights and Responsibilities, was unanimously approved.

6Gx17-7.02 CODE OF STUDENT CONDUCT: SECONDARY RIGHTS AND

RESPONSIBILITIES

Motion by Mrs. Morris, second by Mr. Bailey, to adopt School District Rule 6Gx17-7.02 Code of Student Conduct: Secondary Rights and Responsibilities, was unanimously approved.

5. Public Hearing on and approval of naming the Gymnasium at Pensacola High School the "BARBARA WASHINGTON ROSE GYMNASIUM."

Chairman Jenkins asked if there were any speakers to address this matter; there was no response. Motion by Mr. Bailey, second by Mrs. Morris, to approve the naming of the Gymnasium at Pensacola High School the "BARBARA WASHINGTON ROSE GYMNASIUM" was unanimously approved.

Motion to approve the consent agenda was made by Mrs. Morris and seconded by Mr. Bailey. Mrs. Webb registered a NO vote on this item, stating that due to concerns with possible conflict of interest, she will be requesting mediation and that the Attorney General look into those issues.

5. Authorized payment of $4,392.75 to the legal firm of Hammons & Whittaker, P.A., for legal services performed during the month of April 1998.

Mrs. Webb inquired as to charging for public records issues which have been researched previously. Mr. Hammons responded that instances arise from time to time dealing with specific questions. Mrs. Webb stated that she had not received files that she had requested 16 months ago. She stated that the custodian of the record would be the Secretary to the School Board with reference to public records of previous School Board Members, Mr. Eric Eggen, Mr. Earl Hawthorne, and Mr. Ed Stanford. Mrs. Morris stated that the Board was advised in workshops with the Florida School Board Association and Superintendent's Association that the secretary is not the custodian of the records; the Board Members are (until they leave office) at which time they may refer the records to the Superintendent for custodial purposes. Mr. Ray concurred, stating that the secretary is not the custodian of any School District records.

7. Authorized payment of $200 to Mr. Eric Eggen for legal services performed as Hearing Officer for expulsion of Student Number 98-136-671.

Mrs. Webb inquired concerning charges for this item as well as item #8. Mr. May noted these services are approved in advance when the Board approves requests for formal hearings. Mr. Hammons added that the Board authorized him to deal with a limited list of hearing officers who are utilized on a rotation basis. Mrs. Webb requested that the Superintendent provide information as to when that approval took place, the terms, and how often the list is updated.

Mrs. Morris commented that these were PECO dollars from 1995 that would be lost if not spent by a certain time, and the monies that were shifted would be replaced. Mr. Ted Kirchharr, Director of Facilities Planning, noted that money had been budgeted to paint the exterior of the school and that was completed.

Ms. Linda Finkelstein, 8762 Thunderbird Drive, Pensacola, Florida, reported that the awards banquet was held on May 8, 1998, with a record attendance of 329. Through corporate sponsorship from BellSouth Real Yellow Pages, all 60 winners for the Reflection Program were invited, and the state and national winners were announced. Various awards were given at the banquet including recognition for outstanding local PTA units at Holm and Scenic Heights Elementary Schools, Brownsville Academy of Science and Art, and Washington High School. The "Outstanding Local Person of the Year" was Ms. Judy Lott, Ferry Pass Elementary, and the "Principal of the Year" was Ms. Karen Owen, C.A. Weis Elementary School; in addition, Honorary Lifetime Memberships were given to Ms. Sandra O'Kelly, ECCPTA Treasurer, and Mr. Dick Erwin, Assistant Principal at Brownsville Middle School, and an Honorary Lifetime Membership to the Florida PTA was given to Dr. Elmer Jenkins, School Board Member.

The indefinite suspension provided herein shall not affect the delivery of educational services to the pupil, and the pupil should be immediately enrolled in a day-time alternative educational program.

XII. ITEMS FROM THE BOARD

 

1. Item from the Board - Dr. DeWitt

Motion made by Dr. DeWitt and seconded by Mr. Bailey, to adopt the following Resolution that Dr. DeWitt first presented at the April Board Meeting and which is in this month's agenda material, regarding building "Smart" schools by using the maximum allocation allowed by law:

WHEREAS, this Board is entering into negotiations with architects to plan and design a new K-8 school;

WHEREAS, the State has mandated certain building/construction costs;

WHEREAS, this Board is responsible to provide facilities which meet the educational needs of students, now, and in the even higher tech future;

BE IT RESOLVED, this Board is committed to providing long lasting quality construction, which is driven by current and anticipated curriculum needs, to prepare our students for the 21st Century, and

BE IT FURTHER RESOLVED that this Board desires that, while construction costs must be within State guidelines, we build "Smart" schools, which incorporate the newest technologies, classroom design and function which can best meet the needs of our children in the year 2000 and beyond, by using the maximum allocation allowed by law.

After discussion, Mrs. Morris offered a friendly amendment to the motion, deleting "...by using the maximum allocation allowed by law." Dr. DeWitt accepted the amendment. The Chairman called for the vote and the motion was approved 4-1, with Mrs. Webb voting NO.

2. Item from the Board - Mrs. Webb

Mrs. Webb deferred this item, stating that she would address an issue regarding the minutes with the Chairman.

3. Item from the Board - Mrs. Webb

Mrs. Webb referenced a proposed Interagency Agreement as set forth by the Board of County Commissioners, and she stated that the attorneys may want to research the matter relative to statutory requirements for a concurrency or inter-governmental agreement. After discussion, Dr. David Epperson, Assistant Superintendent for Facilities Planning and Maintenance, advised that Facilities submits plans to the county Planning Department for review relative to drainage concerns, and in the past the county submitted information to Mr. Ireland Brock, Director, Pupil Instructional Support Services, regarding new subdivisions and growth areas. Mrs. Webb requested that staff relay that information to the Board to help in planning and projections.

4. Item from the Board - Mrs. Webb

Mrs. Webb stated that Mr. Jack Kelly had presented a petition in March regarding concerns that proper planning take place in Escambia County, and she noted that Mr. Kelly was present tonight.

5. Item from the Board - Dr. DeWitt

A. Motion made by Dr. DeWitt that Facilities Planning budget from an appropriate fund source, dollars to accomplish bathroom renovations at Workman Middle School to make two bathrooms handicapped accessible. The appropriate budget amendments will come back to the Board for approval when the fund source is identified. The motion was seconded by Mrs. Morris for discussion, noting that the work will be done by the District. Chairman Jenkins called for the vote and the motion was unanimously approved.

B. Motion made by Dr. DeWitt that Facilities Planning budget from an appropriate fund source, dollars to accomplish construction of a permanent dias at the J.E. Hall Educational Center for the purpose of having monthly Board Meetings at the Hall Center. The appropriate budget amendments will come back to the Board for approval when the fund source is identified. The motion was seconded by Mrs. Morris. The cost estimate was $12,000 to $15,000, with the work to be done by School Board personnel. Board Workshops would continue to be held in the existing Board Meeting Room. Mr. May stated that school work orders are critical and would have to take precedence over this project.

Dr. DeWitt concurred, stating there would be no time limits on the project; the schools come first. The Board recognized the following speaker: Mr. Ken Norris, 4400 Bayou Boulevard, Pensacola, Florida, requested that the Board consider utilizing vocational technical students on the Hall Center project rather than School Board personnel.

Following discussion, Chairman Jenkins called for the vote and the motion was unanimously approved.

6. Item from the Board - Mr. Bailey

Mr. Bailey pulled this item, stating that he wished to meet with the Superintendent and staff regarding a recommendation concerning a Training Coordinator and a master plan on safety in the system due to safety concerns which are being addressed across the nation.



XIII. ITEMS FROM THE ATTORNEY

Mr. Ray discussed concerns regarding the manipulative nature of recent telephone calls from Mrs. Webb, and although he could not disclose what was said for reasons of confidentiality, he expressed that he wished to curtail any further disrespectful conduct on the part of Mrs. Webb. He advised that he was serving notice on Mrs. Webb that he will tape record all future conversations with her, unless the School Board takes action asking him not to do so. Mrs. Webb expressed concerns that she felt that the attorney had acted towards her in an unprofessional manner. Mr. Ray stated that he would welcome Mrs. Webb to record any conversations they may have, and he encouraged her to continue to contact him whenever she wants to.

XVI. ADJOURNMENT

The following meetings were scheduled: Friday, May 29, 1998, 9:00 a.m. Executive Session; Monday, June 22, 1998, 1:30 p.m. Regular Board Workshop; and Tuesday, June 23, 1998, 7:00 p.m. Regular Board Meeting. Mrs. Morris asked if the Regular Board Meetings could begin at 6:00 p.m. for the rest of the year. Mr. May stated he would poll staff at the next staff meeting in that regard. He advised that an all-day Strategic Planning Workshop was scheduled for July 29, 1998, beginning at 8:00 a.m., with facilitators from Pinellas County to present the Baldrige criteria and Total Quality Management (TQM) model. There being no further business to come before the Board, the meeting adjourned at 11:11 p.m.
